Terms and Conditions
§ 1 Scope of Application
These Terms and Conditions govern all agreements between MakanChat (hereinafter "Provider") and the user (hereinafter "User") regarding the use of the MakanChat service.
MakanChat is available to all users who access the service via Telegram.
§ 2 Service Description
The Provider operates MakanChat, an AI-powered chat service that helps users discover halal-verified restaurants and dining options. The service is delivered via Telegram and includes:
- Personalised restaurant and dining recommendations based on user preferences
- Menu information and culinary guidance
- AI-generated responses to food and dining queries
All recommendations and responses are generated by artificial intelligence. The Provider does not guarantee the accuracy, completeness, or timeliness of any information provided. Users are responsible for independently verifying information before acting on it.
§ 3 Formation of Contract
A contract is formed when the User first interacts with MakanChat via Telegram and completes the onboarding process. MakanChat is currently a free service; no payment is required to use it.
§ 4 User Obligations
Users must not:
- Submit illegal, offensive, or harmful content
- Attempt to abuse, manipulate, or overload the service or its AI systems
- Share sensitive personal data (e.g. passwords, financial details, health information) in chat messages
- Use the service for any purpose other than its intended use as a dining recommendation tool
Users are solely responsible for the content of their inputs and for any consequences arising from them.
§ 5 AI Disclaimer
Responses from MakanChat are generated automatically by artificial intelligence and are provided for informational purposes only. They do not constitute professional advice (including nutritional, medical, legal, or financial advice). The Provider expressly disclaims any warranty regarding the accuracy or completeness of AI-generated outputs.
Users should not rely solely on MakanChat's recommendations for decisions that may affect health, safety, or financial well-being.
§ 6 Availability
The Provider makes reasonable efforts to ensure high availability of MakanChat but cannot guarantee uninterrupted service. Scheduled maintenance, technical issues, or circumstances beyond the Provider's control may result in temporary interruptions. No compensation is owed for such interruptions.
§ 7 Liability
The Provider is liable without limitation for damages caused by wilful misconduct or gross negligence. For damages caused by slight negligence, the Provider is liable only where an essential contractual obligation (cardinal obligation) has been breached, and only up to the amount of foreseeable, typical damage.
AI-generated recommendations are suggestions only and do not replace independent judgement. The User is responsible for verifying and acting on any information received from MakanChat.
§ 8 Intellectual Property
All rights to the MakanChat platform, including software, branding, and design, are owned by or licensed to MakanChat.
Content generated by MakanChat in response to a User's input may be used by the User for personal, non-commercial purposes. The Provider does not claim ownership of content generated in direct response to User queries.
§ 9 Suspension and Termination
The Provider reserves the right to suspend or permanently block a User's access to MakanChat if the User violates these Terms and Conditions, misuses the service, or engages in conduct that could harm the service, other users, or third parties.
The right to terminate for good cause without notice is unaffected.
§ 10 Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy.
§ 11 Changes to These Terms
The Provider reserves the right to amend these Terms and Conditions with reasonable advance notice. Changes will be communicated to Users via Telegram message. If the User does not object within 4 weeks of receiving notice, the amended Terms are deemed accepted.
§ 12 Governing Law and Jurisdiction
These Terms and Conditions are governed by applicable law. To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be determined by the applicable legal framework.
Should any individual provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original.
